La Ley de Reforma y Control de Inmigración de 1986 (IRCA) y las Enmiendas al Fraude Matrimonial de Inmigración de 1986 (IMFA) proporcionaron cambios drásticos en las leyes de inmigración que afectan a los extranjeros en este país o a aquellos que desean obtener la admisión a los Estados Unidos como inmigrantes. La IMFA estableció un proceso de dos pasos para quienes buscan un estatus migratorio basado en el matrimonio, de modo existiera la posibilidad que una persona inicialmente reciba un estatus de residente condicional que podría convertirse en un estatus permanente después de dos años. La IMFA impuso una prohibición de dos años para obtener la residencia permanente a través de un matrimonio celebrado mientras la persona estaba en exclusión o deportación y una prohibición de cinco años para un residente permanente que solicite un nuevo cónyuge cuando haya obtenido el estatus basado en un matrimonio anterior.
La IRCA de 1986 y la IMFA de 1986 siguen firmemente vigentes. También es importante señalar que, si un inmigrante o aquellos que buscan cambiar su estatus en los Estados Unidos mediante el inicio de una petición de visa I-130 presentada por un cónyuge o un cónyuge que sea ciudadano estadounidense, entonces el USCIS debe determinar si la petición de visa es fraudulenta en el sentido de que las partes simplemente buscan estatus para el cónyuge beneficiario sin ninguna intención real de crear una relación matrimonial legítima y de buena fe de por vida, entonces las consecuencias para ambas partes son considerables.
Según la IMFA y otras leyes de inmigración existentes, si el USCIS concluye que el cónyuge extranjero ha cometido fraude matrimonial o que existe la intención de cometer fraude matrimonial, entonces se le prohíbe buscar cualquier estatus mientras permanezca en los Estados Unidos. El posible estatus de inmigrante sólo podrá lograrse si el cónyuge/beneficiario extranjero realmente abandona los Estados Unidos por un período de quizás dos años o más para tener una posible oportunidad de reingresar a este país como inmigrante basándose en una nueva petición de visa I-130.
Una vez que el USCIS ha llegado a la conclusión de que se ha cometido fraude matrimonial, este hecho sigue siendo parte del archivo de registro permanente del extranjero en cuestión y, por lo tanto, afectará para siempre los intentos de ese mismo individuo de ingresar a los Estados Unidos como inmigrante o tal vez. como no inmigrante en el futuro.
