At each step of the process, various entities might conduct security and background checks on both you and your fianc\u00e9(e). Checks in several databases for national security, criminal history, and other information about you and your fianc\u00e9(e) are common. Fingerprints, names, or additional biographic or biometric information are needed for these types of checks.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">It\u2019s essential to understand this process before it begins. If you need help or have questions, contact an experienced <\/span><span style=\"font-weight: 400;\"><a href=\"https:\/\/krilaw.com\/services\/immigration-lawyers-chicago\/\">Chicago immigration attorney<\/a><\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h3><b>Step 1: Petition for Fianc\u00e9(e) \u2013 USCIS<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">Use the accompanying instructions to complete <\/span><a href=\"https:\/\/www.uscis.gov\/i-129f\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400;\">Form I-129F, Petition for Alien Fianc\u00e9(e)<\/span><\/a><span style=\"font-weight: 400;\">. This form is a request for USCIS to acknowledge the relationship between you and your fianc\u00e9(e). Your form and any supporting documents are reviewed. If further evidence or documentation is necessary, you will hear from USCIS.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Suppose you are able to establish your eligibility. In that case, your Form I-129F will be approved, and your claimed fianc\u00e9(e) relationship will now be recognized. If you can\u2019t establish your eligibility, USCIS will deny your form and tell you the reasons for the denial.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Next, your form is sent to the DOS National Visa Center (NVC).<\/span><\/p>\n<h3>Step 2:\u00a0 Visa Application \u2013 DOS<\/h3>\n<p><span style=\"font-weight: 400;\">The NVC sends your approved Form I-129F to the U.S. Embassy or Consulate, where your fianc\u00e9(e) should apply for a <a href=\"https:\/\/krilaw.com\/services\/employment-immigration-lawyers-chicago\/non-immigrant-visas\/spousefiance-visa\/\">K-1 nonimmigrant visa<\/a>. Typically, this is the U.S. Embassy or Consulate where your fianc\u00e9(e) currently resides.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The U.S. Embassy or consulate will tell you when the visa interview for your fianc\u00e9(e) is to be held. Next, your fianc\u00e9(e) applies for the K-1 nonimmigrant visa and brings the mandatory documents and forms to their visa interview.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The DOS consular officer will determine if your fianc\u00e9(e) qualifies for the K-1 nonimmigrant visa. If they do, it\u2019s good for up to six months for a single entry.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the consular officer doesn\u2019t determine the relationship to be genuine, DOS won\u2019t issue a K-1 nonimmigrant visa. Rather, they will return Form I-129F to USCIS. Generally, if DOS returns a Form I-129F to us after it has expired, the USCIS will allow it to remain expired. Even still, you have the option to file a new Form I\u2011129F.<\/span><\/p>\n<h3>Step 3:\u00a0 Port of Entry Inspection \u2013 CBP<\/h3>\n<p><span style=\"font-weight: 400;\">If DOS grants a K-1 nonimmigrant visa, your fianc\u00e9(e) will then travel to the U. S. and obtain admission at a port of entry with their valid K-1 nonimmigrant visa. However, like other visas, a K-1 nonimmigrant visa doesn\u2019t guarantee admission into the U.S. A CBP port of entry officer makes the final decision about your fianc\u00e9(e)\u2019s admission.<\/span><\/p>\n<h3>Step 4: Marriage<\/h3>\n<p><span style=\"font-weight: 400;\">If your fianc\u00e9(e) receives admission as a K-1 nonimmigrant, you and your fianc\u00e9(e) have 90 days to legally marry.<\/span><\/p>\n<h3>Step 5:\u00a0 Adjustment of Status \u2013 USCIS<\/h3>\n<p><span style=\"font-weight: 400;\">If you legally marry within 90 days, your fianc\u00e9(e) turned spouse can apply for a Green Card by filing Form I-485, Application to Register Permanent Residence or Adjust Status.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">USCIS reviews the documents your spouse submits. They might mail an evidence request to your spouse if additional information or documentation is needed.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Then, you and your spouse will typically be required to come in for an interview.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Suppose you were married for under two years when Form I-485 is approved. In that case, USCIS will approve your spouse for <a href=\"https:\/\/krilaw.com\/services\/family-immigration-lawyers-chicago\/conditional-resident-status\/\">conditional permanent resident status<\/a> and give them a Green Card valid for two years.
