For international students wanting to stay and work in the United States after completing their degree, running out of Optional Practical Training (OPT) unemployment days is a common yet serious risk. The consequences can extend far beyond losing work authorization:

  • F-1 status may be jeopardized
  • SEVIS records may be terminated
  • Future immigration applications may be negatively affected

Options exist, but the timing as you pursue them is critical. At Kriezelman Burton & Associates, LLC, our experienced attorneys have guided international students and foreign nationals through all manner of complex immigration situations like this one. Understanding the limits on OPT well before you reach them is an important means of protecting your status.

How OPT Unemployment Limits Are Calculated

Federal law sets firm caps on how many days an F-1 student may be unemployed while on OPT:

  • Post-completion OPT: No more than 90 days of unemployment
  • STEM OPT extension: No more than 150 days in aggregate, including any days accrued during the post-completion OPT period

SEVIS tracks these days automatically. Unemployment days accrue continuously when no employer information is recorded in the system.

Which Employment Arrangements May Count as Qualifying OPT Employment?

Not all work arrangements are immediately obvious. The following may qualify, depending on the circumstances:

  • Paid, full-time employment with a single employer in a field directly related to your degree
  • Part-time employment, defined as 20 hours per week or more
  • Multiple employer arrangements, provided each position relates to your major area of study
  • Unpaid positions in some cases, such as volunteer roles or unpaid internships, if directly tied to your field of study

Documentation of your employment is essential. Employment that is not properly reported or recorded in SEVIS does not stop the unemployment counter.

How Exceeding the Unemployment Limit May Affect Your Future

Reaching or surpassing the unemployment threshold carries serious legal consequences for:

  • F-1 status: Exceeding the limit is considered a failure to maintain status. This means the student is no longer considered to be in valid F-1 status.
  • SEVIS record: The school’s Designated School Official (DSO) may be required to terminate the student’s SEVIS record, which initiates an unlawful presence clock.
  • Future immigration applications: A terminated SEVIS record and a period of unlawful presence can create significant complications for future visa applications, change-of-status petitions, green card applications, or admissibility determinations.

The longer this situation goes unaddressed, the more severe the consequences tend to become.

What Options Are Available Before or After the Limit Is Reached?

Timing matters immensely for OPT. Whether you are approaching the limit or have already exceeded it, several avenues may be worth exploring with a qualified immigration professional. You may want to:

  • Speak with your DSO immediately. The school’s DSO has reporting obligations and may be able to clarify your situation or assist with corrective action.
  • Explore reinstatement to F-1 status. In some circumstances, USCIS may consider a reinstatement application if the violation was beyond the student’s control and the student has not been out of status for more than five months.
  • Assess alternative immigration options. Depending on your situation, a change of status, employer-sponsored visa, or other possibilities may be available.
  • Consult an immigration attorney before taking any action. Legal errors at this stage can reduce your options.

Watch the Clock to Protect Your Status

OPT unemployment limits leave little room for error. One employment gap, an unreported job change, or a misunderstood rule can have lasting consequences for your immigration journey.
