Bajo las leyes de Inmigración, una persona que desea ingresar a los Estados Unidos como un trabajador de manera permanente debe obtener una certificación del Departamento de Trabajo de que no hay suficientes trabajadores que puedan, deseen y estén disponibles en los Estados Unidos y que el empleo de esa persona no afectará los salarios o las condiciones de trabajo de los trabajadores en los Estados Unidos que tienen un empleo similar.
Para cumplir con el mandato otorgado a ellos, el Departamento de Trabajo ha establecido un sistema denominado PERM. Durante el proceso de PERM, se le pide a un posible empleador que pruebe el mercado laboral para ver si hay solicitantes para el puesto vacante. Esto se hace principalmente a través de diferentes tipos de anuncios. Si el empleador no recibe ningún candidato elegible después de que se complete toda la contratación, pueden presentar la solicitud PERM ante el Departamento de Trabajo. Una vez que el Departamento de Trabajo aprueba la solicitud PERM, se presenta la Solicitud de Certificación Laboral en apoyo de una petición I-140, que otorga al beneficiario la posibilidad de obtener su residencia legal permanente en los Estados Unidos.
