¿Su tarjeta verde de residencia permanente solo es válida por dos años? Eso significa que tiene un estado de Residente Permanente condicional en los Estados Unidos. Dentro del período de 90 días antes de que caduque la tarjeta, deberá presentar la solicitud para cancelar las condiciones de su residencia, de lo contrario su estatus será cancelado. Existen varias excepciones para poder presentar una solicitud después de un período de dos años; sin embargo, tratar este asunto depende de los hechos de cada caso.
El estado condicional se otorga a una persona que está casada con un ciudadano de los EE. UU., pero cuyo matrimonio es menor de dos años al momento de que se le concedió la residencia legal permanente. También se le otorga a un niño cuyo padrastro o madrastra es ciudadano de EE. UU. y el matrimonio entre el padre natural y madrastra tiene menos de dos años. El estado condicional proporciona al Departamento de Seguridad Nacional una oportunidad adicional para determinar que el matrimonio sea real y no únicamente para fines inmigratorios. Si usted (o sus padres) todavía están casados, usted y su cónyuge ciudadano de EE. UU. presentarán la solicitud juntos. Si está separado o divorciado de su cónyuge, deberá presentar la solicitud en los siguientes casos:
- Su cónyuge ha fallecido
- Se casó de buena fe (es decir, no para fines de inmigración) pero el matrimonio ya ha terminado debido a un divorcio o anulación
- Se casó de buena fe pero su cónyuge abusó de usted
- Usted es un niño y su padrastro ciudadano de los EE. UU. abusó de usted
