Immigrants are essential contributors to the United States economy through their work. In America, immigrants can obtain a visa to remain in the country and gain employment. There are many different types of visas available, depending on the type of work or investment the immigrant wishes to make. The application process is often challenging, though, and one small mistake could ruin a person’s chances of entering the country. If you want to come to the United States to work, it is important that you speak to an Evanston employment immigration lawyer.
Unlike many other types of people wishing to come to the United States to work, people with extraordinary abilities do not require a specific job offer. They must simply intend to work in the fields in which they have a specialized skill or ability. Outstanding professors, researchers, and multinational managers or executives can also apply for an E1 Visa. These individuals do need to have a job offer and must have three years of experience in their field.
Individuals wishing to apply for an E2 Visa must have a job offer in the country and, in most cases, a labor certification by the Department of Labor. Employers that want to hire these individuals must file a Petition for Alien Worker, Form I-140. Applicants in this category must be professionals with advanced degrees or people with exceptional abilities. People with exceptional abilities in the arts, sciences, or business are also eligible for an E2 Visa.
Anyone who would like to apply for an E3 Visa must either be a skilled worker in a field that requires at least two years of training or work experience, professionals that require a U.S. university or college (or a foreign equivalent) to work in their field, and other workers that do not require two years of training or experience. Temporary or seasonal workers do not qualify for this type of visa. These visas are reserved exclusively for Australians.
There are many different types of workers that qualify for an E4 Visa. They include broadcasters, ministers, some former employees of the Panama Canal Company or the Panama Canal Zone, certain Iraqi and Afghan interpreters, and more. An Evanston employment immigration lawyer can help applicants determine if they fall into one of the categories eligible for an E4 Visa. Most, but not all, applicants in this category must be the beneficiary of an approved Petition for Amerasian, Widow(er), or Special Immigrant.
Individuals that wish to invest in the country or create jobs in the United States can apply for an E5 Visa. Investors must be able to invest $1 million or $500,000 in an area with high unemployment rates. Investors cannot borrow any part of their investment.
